Description of Goods

Photographs, drawings, diagrams and descriptions are for guide purposes only and do not necessarily represent the products on offer; any sizes, capacities and dimensions quoted are approximate and also for guidance purposes only.
Garden Magic Ltd. reserves the right to change the description or specification of its products without notice.

Prices

The prices shown on our website include VAT at the applicable rate and are for guidance only. Where a "call" status is shown in the price box this means the item is no longer available for sale, but you are invited to telephone the Garden Magic Ltd. Sales office on 01902 568066 for advice as to an alternative. Any discrepancy in pricing will be advised to you by email and you will have the opportunity to revise or cancel your order at that stage. Please note that delivery charges are charged on each order. The delivery options and prices are displayed on the Shopping Basket page and added to the total value of your order.

Any Garden Magic Ltd. offers or discount arrangements not referred to on the Garden Magic Ltd.  website are not applicable to prices displayed and Garden Magic Ltd. reserve the right to alter the displayed prices without notice.

Availability of Goods

We endeavour to indicate the availability of products held but on occasions, due to circumstances beyond our control, products may be temporarily out of stock and we are unable to guarantee their availability at all times. Garden Magic Ltd. will in no circumstances be liable for the non availability of any product.

In the unlikely event that we are unable to fulfil any aspect of your order we will advise you on your delivery note/invoice and we will refund your credit/debit card account within 3 working days of the invoice date, or send you a cheque if you have paid that way.

Special Offers and Promotions

In order to maintain supplies for all its customers Garden Magic Ltd. and reserve the right to limit the number of products on promotion or special offer that may be ordered by a customer.

Cancellation or Amendment of Orders

When you place an order to purchase a product from Garden Magic Ltd we will send you an e-mail confirming receipt of your order and containing the details of your order. Your order represents an offer to us to purchase a product which is accepted by us when we send e-mail confirmation to you that we've despatched that product to you (the "Despatch Confirmation E-mail"). That acceptance will be complete at the time we send the Despatch Confirmation E-mail to you. Any products on the same order which we have not confirmed in a Despatch Confirmation E-mail to have been despatched do not form part of that contract.

Because we endeavour to fulfil all orders immediately we regret that it may not be possible for you to amend or cancel your order once it has been placed. Although if you phone or email as soon as possible we will update the order if it has not been despatched.  However you may take advantage of our 14 day money back guarantee.

Payment

We accept payment by Master Card and Visa credit cards and by Switch, Delta and Solo debit cards only. For your protection your credit\debit card details will be encrypted.

Before your order is accepted your card details will be checked and payment verified. You will receive email confirmation of our acceptance of your order, provided we have been supplied with a valid email address.

Delivery

The delivery charges on this website are for the UK mainland only.  Deliveries to: Northern Ireland, Isle-of-Wight, Remote areas of Scotland, E.C. Countries and the rest of the world will cost more.  Please contact us for a quote.

Our standard delivery service aims to deliver your order on mainland UK within 3 working days (Mondays to Fridays excluding Bank Holidays) following the day on which your order is accepted, although we cannot guarantee this.  Please see our Shopping Basket page for more details of the delivery services available.

Deliveries must be signed for by someone aged 18 years or over. If no one is available to receive your order at the time of delivery the delivery driver will leave notification of the attempted delivery and return the goods to the depot from where you will be responsible for arranging collection.  Delivery will only be made to the delivery address specified at the time the order is placed.

We will notify you within 24 hours (usually same day) of the date the goods were despatched. Shipping will be by Royal Mail 1st Class Post, or by next day courier.  Claims for non-delivery or of damaged goods must be made as soon as possible and in any event within 7 days of the despatch date

Guarantees

Garden Magic Ltd.  14 day money back guarantee

If for any reason you are not satisfied with your goods Garden Magic Ltd. will refund the price of the goods provided that they are returned to us at:   PO Box 4066, Wolverhampton, WV3 9WZ,   unused and in their original condition, together with the original packaging, within 14 days of the date of the invoice, which you must also enclose with the goods.

Hand Tools: Garden Magic Ltd.  hand tools carry a one year guarantee against faulty materials and workmanship.

Garden Watering: Garden Magic Ltd.  irrigation and lighting equipment  is guaranteed for six months from the invoice date against faulty materials and workmanship.  We are not liable for frost damage and recommend that timers, manifolds and sprays are over-wintered indoors.

Fair Wear & Tear

The above guarantees do not apply to fair wear and tear or damage caused by misuse or abuse of the products.

Limitation of Liability

Garden Magic Ltd. liability (even if it has been negligent) shall not extend to:

·  loss of business, income or profits

failure to make predicted savings

"wasted" expenditure

losses which are not a direct consequence of the action (or lack of action) of Garden Magic Ltd. or its sub-contractors, Trading Partners or agents

any other consequential loss;

and, to the extent allowed by law, shall be limited to the value of the goods supplied.

Statutory Rights

Consumers’ statutory rights are not affected.

Reservation of Rights

All rights in the photographs, drawings, design, "get up", information and part numbers on the Garden Magic Ltd.  website are owned by Garden Magic Ltd. and may not be copied or printed (except for your personal use in connection with the placing of an order) without first obtaining the written consent of Garden Magic Ltd.

The names and logos of Garden Magic Ltd. and Waterbymagic.com are trademarks or registered trade marks of Garden Magic Ltd. The names or logos of Trading Partners may be the trademarks or registered trademarks of such Trading Partners.

Data Protection and Privacy

The personal information with which you provide us will be safeguarded by Garden Magic Ltd. and will only be used for certain specific purposes.

Miscellaneous

To order goods from the Garden Magic Ltd.  website you must be at least 18 years of age, resident in the United Kingdom and have registered as a Garden Magic Ltd. customer.

Garden Magic Ltd. reserves the right to:
